By accessing or using Apptuned Focus ("the Service"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, please do not use the Service.

These Terms constitute a legally binding agreement between you and Apptuned Ltd, a company operating under Kenyan law.

Apptuned Focus is an AI-powered cognitive support and productivity application designed to assist individuals — including those who are neurodivergent — in managing tasks, planning, and daily routines.

⚠️ Apptuned Focus is NOT a clinical, medical, or therapeutic tool. It does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for clinical support needs.

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and current information during registration.
• You may not share your account or use another person's account.
• You must notify us immediately of any unauthorised access to your account.

• Apptuned Focus offers free and paid subscription tiers.
• Paid subscriptions are billed in advance on a monthly or annual cycle.
• Subscription fees are displayed in USD. Local currency equivalents may vary with exchange rates.
• You authorise us (via our payment processors) to charge your payment method on each billing date.
• Subscriptions renew automatically unless cancelled before the renewal date.
• Downgrades take effect at the end of the current billing period.

When using AI-powered features, you agree that:

• AI responses are generated automatically and may be inaccurate, incomplete, or inappropriate for your specific situation.
• You will not rely on AI responses as a substitute for professional advice (medical, legal, financial, or therapeutic).
• You will not input illegal, harmful, abusive, or privacy-violating content.
• You will not attempt to manipulate the AI into producing content that violates these Terms.
• You will not use the AI to impersonate others or create misleading content.

Our IP: The Apptuned Focus application, brand, design, code, and AI prompts are owned by Apptuned Ltd. You may not copy, modify, or distribute them without written permission.

Your content: You retain ownership of all tasks, notes, and data you create. You grant us a limited licence to process and store this content solely to provide the Service. We never claim ownership of your personal data.

You may not:

• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to other users' data
• Scrape, crawl, or systematically extract data from the Service
• Use the Service to develop a competing product
• Circumvent or disable security features
• Upload malware or malicious code

We aim for high availability but do not guarantee uninterrupted access. The Service may be unavailable during maintenance, updates, or due to circumstances beyond our control (force majeure, third-party outages, etc.).

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where possible.

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for decisions made based on AI-generated content.

Some jurisdictions (including Kenya) may not allow certain liability exclusions. In such cases, our liability is limited to the fullest extent permitted by law.

You may close your account at any time from Settings. We may suspend or terminate your account if:

• You breach these Terms
• We are required to by law
• Your account has been inactive for more than 2 years

Upon termination, your data will be deleted within 30 days except where retention is required by law.

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to mediation under the Nairobi Centre for International Arbitration (NCIA) Rules before litigation.

EU users may also raise disputes with their national consumer protection authority.

We may update these Terms. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use constitutes acceptance.
